Newhall Land and Farming Company Petitions California Supreme Court to Reconsider Newhall Decision

The Newhall Land and Farming Company has petitioned the California Supreme Court to reconsider its November 30, 2015 decision blocking a mixed-use residential project in Los Angeles County.

Newhall argues that the Court’s decision was based on incorrect legal reasoning and a misunderstanding of the relevant facts, particularly as they relate to the relocation of the endangered three-spined stickleback fish as a mitigation measure. The Court had held that this mitigation measure would result in a “take” of a fully protected fish. Newhall claims that the Court made its holding based on issues not properly raised before it.

Environmentalists and other groups opposing the project counter that the issue was in fact properly briefed and raised, and that Newhall should have cited to evidence in the record during the original hearing.
