The Mather South Project final Environmental Impact Report (“EIR”) was challenged by Tsakopoulos Investments in late February 2020. The Mather South project would be an 848-acre project on undeveloped land with up to 3,522 residential units, a 28-acre environmental education campus with 200 multifamily units, a 21-acre research and development park, and 21 acres of retail.

The lawsuit, seen by some as an anti-competitive use of California’s environmental laws, requests a temporary restraining order, and alleges that the County did not address the lack of climate action plan as part of the Mather EIR. According to Tsakopoulos, the County is not making provisions for likely impacts from Mather South from a climate change perspective, which impacts supposedly directly affect Tsakopoulos as the developer for Jackson Township southwest of Mather South. The lawsuit also contends that the County is unfairly favoring the project because the County’s Economic Development Department owns much of the Mather South land.

Sacramento County Superior Court has not yet scheduling hearings for the suit.
